Cooperation: the United States ready to collaborate with the DRC in the field of military justice

The American diplomat, Lucy Tamlyn, underlined during an exchange this Monday, April 17, 2023 with the Deputy Prime Minister in charge of National Defense, Jean-Pierre Bemba, the possibility of collaboration in the field of justice. military between Washington and Kinshasa.

Lucy Tamlyn took this opportunity to present the support that the Biden government plans to provide to the Democratic Republic of Congo, especially in the field of military justice.

"We have experience in military justice and our discussions with the Deputy Prime Minister were also in this perspective, because it is a mutual interest between our countries," said the American diplomat.

Before adding that "Ambitious projects are to be imagined to make this momentum of cooperation between Kinshasa and Washington effective".

*To Remind,

US International Development Finance Agency intends to boost the electric battery factory project in the DRC

After being received at the US State Department, the Congolese Minister of Industry, Julien Paluku Kahongya, and his colleague from Finance, Nicolas Kazadi, met with the team from the American Agency for International Development Finance (DFC) led by its Executive Director, Scott Nathan.

During this strategic meeting, the American financial agency announced that it will support the acceleration of the realization of the pan-African project to establish the first factory for the production of electric battery precursors in the province of Haut-Katanga in the Democratic Republic of Congo.

For the Congolese delegation, this expression of interest from DFC is a cause for satisfaction.

Moreover, representatives of the Congolese government have requested that the American agency also support the establishment of Special Economic Zones in the six (6) industrial areas in the country.

It is worth noting that these meetings took place in the presence of Denis Lecouturier, Kakule Vuko, and Jean-Marie Kanda, respectively the General Director, Deputy General Director, and Administrator of the Congolese Battery Council (CCB).

Cominiere have obviously said that they want to cancel the JVA....( says it below in the snip ) but just like how they’ve gone about ROFR...they don't comply with the terms of the JVA...they would have needed to have gone to ICC and got it nutted out there that they were all above board and able to terminate...they haven't don't this, they’ve just said that's what they’re doing...what they mouth off and what they can do are two separate things.

Parties can just wake up one morning and sat ye nah we’re done, let's go home ; there's legal far, works drawn up in JVs (JVA) which need to be followed. You really think CCK discovered a series of loopholes ; the guy is one of the biggest idiots out there...what most likely happened is that he fired a bullet into the ceiling when his negotiating terms he had tabled weren't going anywhere, told AVZ that he was cancelling the agreement..expected / hoped for a different reaction and AVZ responded with a ‘we’ve had enough of your bullshit and trying to reason, deal with it in icc which will include this and a number of other issues...there will be Nada in the JVA that cominiere could pull the plug on AVZ for as AVZ have been above board...pretty sure the legal could walk anyone through the JVA and show them that Cominiere are clowning around, don't have a leg to stand on and delaying

This ☝️

Also believe that Zijin have lost their rag with CCK (them leaking the audio as a warning shot), he was under orders and as AVZ didn't agree to Zijins no doubt ludicrous terms he pulled the trigger to dissolve the JVA.

Cominiere are literally and I'll add shamelessly just a conduit for Zijin.

This however does place Zijin and Cominiere in an interesting postition as AVZ have gone straight to ICC instead of fannying about with the pathetic Government who would only stall and mess things up further, great move.

Not sure they were expecting and certainly know they will not want this going infront of ICC out in the public for all too see the absolute corruption and vile way global ccp company Zijin do 'business'. Zijin especially are not going to want their dirty deeds exposed on the world stage, so now the pressure gets placed upon the criminals of Zijin and Cominere to come to an agreement before the big reveal. Of course Zijin will continue to delay as much as possible, but that ICC date gets closer with each day passed.

In parallel one hopes that the recently formed IGM (to combat mining fraud and smuggling....I know, I know😂) has more teeth than the IGF who caught out MOP and Cominiere but suspiciously bare minimum happened. Even if Manono/Dathcom/Cominiere was first on the IGM list it will take 6-9months for a full investigation, then we hit DRC time on what decade they feel like releasing it and then acting on this with maxmium docility.

One thing I'd appreciate someone informing me is how on earth can we still be granted the ML without first sorting this mess out, as I remember one of the reasons given by Antoinette that our ML was taken back was "you boys are not playing nicely".

I can't see the Americans agreeing to support the SEZs if Zinjin/China were going to be major beneficiaries by them controlling/owning Manono .
So with Americans confirming their support just last Friday ...the cavalry have arrived .
Thanks Frank !

What it will tell us is that they are all in on it . All on the take . From the TOP down. We need to put the hard word on MoM and Felix. If they don't want to respond we need to give it massive media exposure . Front page New York times , The Weekend Australia , the French Press. At some point we need to call TIME on the current approach and go all in .
There are people here more qualified than myself to write a compelling case, but here's a link to "Send a Confidential News Tip" to the New York Times. I'm sure the largest lithium deposit in the world being hijacked by Chinese corruption will catch the attention of many Americans and investors. EVs and anything related to them is likely to get a spotlight. Living in the US and happy to faciliate in any way that I can.

Nigel the beagle is my next door neighbour’s dog…. He’s the one who gives me all my information, as if things aren’t already confusing enough

Please don’t confuse him with those other two you mention who belong in the plastic bags you use to pick up the turds! 😉

I just had a read of the full chinese ver of 2022 annual report of Zijin Mining (Link: https://www.zjky.cn/upload/file/2023/03/24/5e2b3c3a1fa74e60af3d1bbf9c56becf.pdf ) trying to find any mentions of manono project, there're the findings:

- on page 191, where all JVs are listed, it states it's part of "Dathcom Mining SA (Note #6), with 15% indirect shares"
- Note #6 says "According to procedure of Dathcom Mining SA, the board is made of 6 directors, Zijin can assign one director. Zijin management believes Zijin can make significant influence on decision making (financial and process wise) and therefore counting Zijin as part of the JV in this annual report

There's no other mentioning of Manono in this entire report.

imo Zijin is trying to avoid talking too much on this project which is a good thing because they are not confident with what's gonna happen next.

Also doing my weekly chinese media scan, there's only a few new news about manono project, most are neutral, one is extremely biased (towards to Zijin of course), i'm posting the translation below for entertainment, it has mentioned something i didn't know before e.g. (HSBC (third largest holder on T20) actually holds shares on behalf of a Chinese battery company, which is Tianhua Times, a joint venture between Ningde Times (aka CATL) and Tianhua New Energy.)

More drama! One of the world's largest undeveloped lithium deposits is about to change!

Mining Exchange

2023-04-17 20:00
Hebei

On April 12, 2023, the owner of the Manono project, the third largest lithium mine in the world, the Australian AVZ company was "forced to suspend trading" by ASX. Before that, AVZ had been in a state of "voluntary suspension".
From voluntary suspension to forced suspension, AVZ not only fell into the "mud", but also made it difficult for its shareholders. According to the official release of AVZ, 49.53% of its shares are in the hands of 20 major shareholders, the largest three of which are Yibin Tianyi Lithium Industry (6.73%), Huayou International Mining (6.14%) and HSBC Australia Branch (5.99%). The first two are Chinese-funded companies, and HSBC actually holds shares on behalf of a Chinese battery company, which is Tianhua Times, a joint venture between Ningde Times and Tianhua New Energy. AVZ was forced to suspend trading, and the investment of Ningde Times, Tianhua New Energy, and Huayou Cobalt may be "in vain"!

The main business of AVZ Minerals is mineral exploration in Africa, including copper, vanadium, lead, zinc, lithium, tin and gold. The Congo (Kinshasa) Manono project owned by it is one of the hard rock lithium deposits with the largest reserves and the highest grades discovered so far. According to the feasibility study report of AVZ Company in July 2021, the ore reserves of the Manono project are 131.7 million tons, and the average Li2O The grade is 1.63%, equivalent to 5.36 million tons of LCE. If it is compared horizontally with the current spodumene project, its resources are second only to Pilbara Pilgangoora and Thaleson. The latter's resources are equivalent to 6.93 million tons and 6.9 million tons of LCE respectively, making it the third largest lithium mine project in the world.

According to the feasibility report released by AVZ in April 2020, the designed production capacity of the Manono project includes an annual output of 700,000 tons of lithium oxide, and the design life is 20 years. According to the follow-up purchase agreement, the project will supply up to 160,000 tons/year to Ganfeng Lithium; Shengxin Lithium will purchase 160,000 tons in each contract year (+/ -12.5%); Tianyi Lithium’s initial purchase period is 3 years from the date of AVZ Mining’s supply. After the expiration, the buyer can choose to extend it for another 2 years, and purchase about 200,000 (+/-12.5%) dry metric tons per year Spodumene concentrate of...
Although the Manono lithium mine has not yet been developed, its production capacity seems to have been divided up by various companies, which shows its "hotness".
According to AVZ Mining Company's plan for the Manono lithium project in the next three years, the Manono lithium mine project is expected to be completed and put into production in 2023, the first batch of lithium concentrate products will be shipped in the first quarter of 2023, and the first batch of lithium sulfate will be shipped in the third quarter product.
But now it seems that putting into production in 2023 has become a luxury! Even the ownership of the Manono lithium project has become a suspense!

The fate of AVZ is inseparable from its own violations of laws and contracts, reselling of shares, false publicity and other behaviors!
AVZ is the original developer of the Manono lithium project. It has formed a joint venture with the Congo (Kinshasa) national mining development company COMINIERE and a company called Dathomir Mining Resources Company (Dathomir) to develop lithium mines. AVZ owns 60% of the shares of Dascom, and the latter two companies own 25% and 15% respectively. AVZ had sought to acquire a 15% stake in the Manono lithium project held by Dathomir, but the transfer of the shares was flawed and terminated on May 14, 2021.
In 2021, AVZ falsified shareholder certificates and shareholder registers, deleted 15% of Dathomir's shares, and changed AVZ's shareholding ratio to 75%, raising funds based on false information. According to the judgment of the Court of Grand Instance (TGI) RP 14944, Graeme Johnson, General Manager of Dathcom appointed by AVZ, was sentenced to 3 years in prison for the above-mentioned offenses.
Zijin Mining acquired a 15% stake in the Manono Lithium Project on November 20, 2021. In 2022, according to a report in the Australian Financial Review, AVZ instructed its intermediary to amend its business registration records with the intention of deleting Zijin Mining’s legal holdings in the Manono Lithium Project. share information.
On December 6, 2022, COMINIERE, a state-owned enterprise in the Democratic Republic of Congo, formally sent a letter to the Ministry of Mines, exposing a large number of breaches of contracts and illegal activities of the Australian mining company AVZ, and asked the Ministry of Mines to revoke the signed Ministerial Order PE13359, that is, revoke AVZ Mining Manono Lithium Mining License obtained by the company.
On January 28, 2023, the Ministry of Mines issued a ministerial-level decree, and the Manono lithium mining license was officially withdrawn.

At present, the Congo (Kinshasa) National Mining Development Corporation (COMINIERE) still holds 25% of the Manono lithium mine project, Zijin Mining holds 15%, Tianhua Times acquires 24% of the shares, and AVZ’s shareholding has dropped to 36%. The biggest "instigator" of mining rights being revoked! The relationship between AVZ and Congo (Kinshasa) has fallen into a "freezing point".
In order to ensure the smooth construction of the mine, the Congolese (Kinshasa) government is likely to find "takers" from other shareholders. On the one hand, it can reduce the number of shareholders and avoid conflicts of interests and conflicts among shareholders; In terms of popularity and attractiveness, other shareholders are undoubtedly the best candidates, and the rest of the Chinese shareholders may come to the fore.

Well if we are at a 'freezing point' whatever that may be. May I suggest Zijin buy us out for the remainder of our apparent 36%🤣😂.
