Hi Obe great post . As usual the devil is in the detail. I like most others assume that the issuing of the mining licence automatically triggers the CATL deal but as you pointed out that is not necessarily the case
My thoughts are however that given the number of things wrong with how we got to the current situation ie Com / Zijin with mining licence for 152275 and Com as permit holders of the remainder ( south ) of 13359 it would be almost impossible for DRC Govt to fix this mess and issue the mining licence to Dathcom without implicating multiple ministers, senior govt admin and the judiciary etc with serious fraud and bribery. Also they would have Zijin hot on their tail ...a case of out of the frying pan and into the fire
Much cleaner for them to just issue the mining licence to Kobold for 13359 ( currently in Comminieres name ) via an executive order from Felix. I assume the agreement between Kobold and DRC covers all this including the fact Kobold will compensate us for cancelling all ICC and ICSID cases against DRC.
This brings us back to the current situation with AVZ negotiating with Kobold for "Fair" compensation.
For me it is hard to see how this can progress any other way

I was referring to some comment on here from a few weeks ago about the DRC asking Kobold for some kind of fee as part of the agreement. No idea if true of course.

I think it is more like:
Kobold has been informed by a their lawyers, that if the DRC doesn't solve their legal problems with AVZ, all Kobold will be buying is multitude of ongoing arbitration cases. Of which they still have to study the finer details and implications.

Therefore KOBOLD has said: 'Listen Felix, sort your own self inflicted shit out, before we can do business'.
(They said that of course after getting the other PR's assigned to them)

Comminière SA illegally, without reason (other than not making progress), kicked AVZ off the PR13359 lease and illegally cancelled a JV (The reason why AVZ could not make progress was, the DRC issued and without reason (other than lack of brown paper bags) withdrew the Mining License).
Don't the idiots understand that you cant mine or build a mine without a mining license?

Comminière SA sold against its contractual FROR obligations with its JV partner AVZ 15% of Dathcom to Zijin.
Followed by illegally cancelling the Datcom JV, of which Comminière SA a minority shareholder was and told AVZ PR13359 is now ours.
And that was not all, they followed through on second thoughts with illegally converting the 15% holding in Dathcom into more than half of PR13359 to Zijin and reassigned that within 1 month into an Exploitation Permit. (without doing any of the required exploration or other legal work, other than receiving another US$70 million, which surprising disappeared like snow in the sun.)

And now the DRC wants Kobold to clean up their mess and on top of that Comminière SA expects a finder's fee of US$ 1 Billion from Kobold.

So what has to happen to make things work??

The DRC has to clean up its own mess, remove Zijin from the northern section, kick a couple of criminal heads operating in Comminiè and reissue a ML to AVZ over the original PR13359, which according to CAMI was never cancelled, without that Kobold will simply walk away. And the ICSID arbitration will continue.

Kobold doesn't have any intention to stick both arms plus head in a DRC vipers nest, just to entertain Felix, or Trump and destroy their company in the process. They do have a responsibility towards their shareholders.

And we still haven't talked about the Hydro Power station for which AVZ had an Contract to refurbish with Snel.
(SNEL is a state-owned company in the DRC for electricity production, transmission and distribution.)

I would say AVZ begrudgingly will walk away from Manono, after Kobold drops US$10 Billion in AVZ's bank account, otherwise no deal.

Yes you are right Kobold may not be bullying AVZ by throwing it back to the DRC to solve . But what they are saying is , Negotiations are over .This is our final offer. Take it or leave it . You have to love Kobold . Squeaky clean . Full of high standards / principles and ethics . Yet they know the DRC Gov are a bunch of Criminals and have no problem doing business with them . They know AVZ hold the legal rights and 21000 share holders got shafted . They know the true value of the deposit . Yet rather than pay fair value they would rather rat f--k us . Kobold are a bunch of grubs in my opinion.
