I agree, I would prefer to see a translated copy of the decrees so that shareholders have transparency on what is actually occurring, as opposed to the BoD cherry-picking two aspects that the decrees “acknowledge”… unfortunately they have shown time and time again that their view of the world - and what is happening in the DRC - is tenuous at best.Why don’t the publish the decrees?

yes, adding the additional content within the ann; it would suggest that this thing has been pulled back behind the line and Nigel may well be required to extend his stay in SA . 'Precondition to progress' (sounds a bit lengthy) , AvZ / Momentum seemed to have been stuck in a waiting position and always just waiting for notification and invoice to be issued as they reckoned they acted all in accordance with mining code ; nothing has moved and no agreements, so now they need to get back to the table and work through it in a 'harmonious and healthy cooperation...we've seen how cooperate Cominiere were in the MMCS ICC case...bloody hard work, but likely under FT instruction now is to get this thing moving...do Cominiere retain the 15% to Zijin and now free to open up bids for the 15% ande back to Zijin at a more palatable ... will AVZ now need to consider fucking off the ROFR and just getting on with this ? obviously as we stand there are legal constraints with ROFR etc so advise would need to be sought, but this think has clearly just popped out of the blue.
let Zijin take up the 15% if that's what's needed to get this across the line; wouldn't be an enjoyable partner at the desk, but competent miner that could lead to some good acceleration. These acknowledgements certainly doesnt sounds like it's all over, but probably suggests that we may need to bend over a bit.

All is not necessarily lost.
Surely the board can see the writing on the wall, and will bring stakeholders together and make the necessary compromises in order to get this over the line, and in the process protect their millions of free performance shares. Never bet against self interest.
This will get sorted, because if it doesn't everyone loses big time, including individual board members.

Wait for ICC and we go with ICC decision to take to our little harmony meeting with DathcomShareholders of Dathcom are AVZ 75% and Cominiere 25%.
The 15 % sale of Dathcom which Cominiere holds has to be sorted and the 10 % of Dathcom which Cominiere holds has to be ceded to the DRC Government.
This all has to be carried out in an harmonious way.
That is the desire of the MoM, representing the DRC Government.
Zijin want the ML .They want control . imoI dont think things are lost..............not by a long shot!
FT doesnt want to ruffle feathers with the Chinese, cause they have a strangle hold on the DRC financially and want their pound of flesh in return, plus they could be very influencial when it comes to FT re-election prospects......positively or negatively
So essentially, FT is asking AVZ to compromise and smoothe the waters with the likes of Zijin, possibly MMCS too, which gives FT a soft landing.
So the choices..........If AVZ want to go mining, then go to bed with ZIJIN , allow them the PREEMPTION 15% but require them to pay full market value and recompense AVZ a percentage for the capital outlay to get the DFS to favourable opinion status..............demand they drop the ICC case.
ZIJIN then contributes 15% to to the capital requirements for construction of RD..........less BFS for AVZ to seek.
ZIJIN are good mining constructors, so an advantage in that regard
AVZ should also seek to obtain 100% exploration rights regards to CDL, but probably will have to offer up a JV with Zijin on generous terms.
As long as AVZ retain 51% control of Manono ( as per DRC law........whatever that means these days ), then its still a license to print money big time.
The chinese always like to win, so even tho AVZ loses pre-emption, which was never a given in the first place, then its still a WIN WIN for all parties
The other choice is a TO.............but i aint smart enuff to understand how that would play out ....

This is so accurate, the parents being the fucking IDIOTS they are have gone an put the ice-cream in the fridge.At face value, I don't know whether the Chinese have anymore leverage than AVZ now either.
The way I see it is it's as if the Parents have just shouted at the kids for bickering over who gets to scoop however much ice cream. So they've decided to put the ice cream in the fridge and taken the spoons away and told the kids to settle down and work it out amicably because they are loosing 300K a day on a potential tax windfall.
There is of course the corruption leverage but even that seems tricky for them now.

That's kinda how i looked at it, same as Amovatio's post on HC.my initial thoughts like a lot of us here was "we're fucked"
Had a shit and a shower and took a few deep breaths and thought through things on a different angle than doom and gloom.
Everyone has taken the view that it's been someone, be it comi, zinjin or such blocking progress to the ML.
What if everyone has gotten it wrong and it was AVZ that did not want to progress to ML as the terms in the ministerial decree were not favorable or to AVZ's liking.
i.e.
The ministerial decree splitting of 13359 was not to the liking of AVZ
and
the ministerial degree progressing 13359 to a PE or mining license with Zinjin as a stakeholder was contrary to AVZ's interests.
hence the statement about ongoing disagreements, conflicts and differences between shareholders that have stalled the project.
For the project to go ahead as per the mining code, with the entirety of 13359 intact and with Zinjin not a stakeholder of Dathcom. Wouldn't these previous ministerial decree's have to be rescinded and then new decree's issued? new decree's that don't split 13359 and don't include Zinjin as a stake holder of Dathcom.
Even if I'm wrong about it being AVZ not being the party stalling the progression to ML. It makes sense to me that if Zinjin got in the back door and AVZ did not want them as a stakeholder, these are the steps they'd have to go down to get Zinjin and any other unwanted stakeholders off the project.
in a nutshell "we (AVZ) are not going to production or moving forward with Zinjin as a stakeholder"
