So Zijin asking for AVZ to show great cooperation in order to advance the development of Manono with other Dathcom shareholder whom they claim to be a part of again ; Dathomir also mentioned a number of times within this article. Dathomir nor Cominiere have zero interest in mining this thing ; they couldn’t nor would want share in the financial lifting required to get this project rolling.
Scenario - Cancelling of the decrees
Decree 1 - Cancelling the decree which AVZ allegedly renounced the north section
; this is obviously what AVZ would have wished for , this does provide the carrot for the entire 13359 tenement to fall back under exploitation licence Decree 2 - cancelling of ML for south ; obviously this would need to happen if the North and South was to become a single tenement again , so it’s welcome ; but it’s a concern , as we are more exposed to the whole thing just getting ditched ; there’s more of a window of opportunity here for thief’s to get their hands in and snatch something.
Neither Dathomir or Zijin will want to go to ICC; ICC is not a table that these guys are happy to play at ; it’s above board . They’d highly likely lose and end up with nothing out of Manono if they attend ICC.
This cancelling of decree clearly came out of the blue ; totally leftfield , Nigel now finds himself from a -‘ imminent, wink wink’ to an oh fuck situation where the gatekeeper of the licence, MoM has canceled the decrees and instead of just issuing another to cover the lot and get us back trading again, the cancellation is basically worded that we need to get to the table and sort out shit out with the other shareholders….
Dathomir is still at 15% on many holding docs even though we’ve paid what they were entitled to under the scheme of arrangement , Zijin claiming 15% and in their latest claim that say that they encourage AVZ to show greater cooperation with the other Dathcom shareholders. Of which they clearly claim to be one despite the video when they renounced their own interest in the project ; most likely a staged video to take some initial heat back off the situation which it was getting ; in order to rally a few more brown baggers up the ladder and sidewards before going at it again…. Which now they seem to have .
Nigel was probably at the point prior to these cancellations, where he thought that North was the area under siege and the south was under lock and key albeit still waiting for the mining rights invoice ,but we’d eventually get it under south with some direction from Felix and battle on for the North.
Cancellation of both decrees with ‘urgency’ now attached ; need to sit down with other shareholder of dathcom …
Zijin - telling us to join in on the fun and let’s discuss ! We encourage AVZ to show greater cooperation with the other Dathcom shareholders.

It confuses me as to why the PE was cancelled as I see that one as being the way to go about it. See below what AVZ stated in the announcement last year.
My thoughts and posts at the time were to just pay Cong his $50mil and secure that 15% and let Zijin have their 15% . They will contribute to the build and bring expertise . To concentrate on Roche Dure/sth CDL and don't risk losing it at the expense of trying to secure nth CDL. We would be building a mine now and the SP over $1 . Maybe it's time to put egos to one side . Sometimes it's not just about how much money you can make , but making sure you don't lose your money . I think the article has some printing or translation errors obe. I also think some here are not fully aware of how the whole mess instigated by State owned Cominiere is difficult to undo and put right legally.
I’m keeping the spotlight in the press around corruption in the DRC mining sector until Tshisekedi makes a judgment in our favour and I am prepared to do that right up to and after the election if I have to.
@wombat74 there is no question Dathomir would lose their claim at the ICC in my opinion. The proof is in the detail, and thank goodness Nigel has done things legally and didn’t fall into the trap of paying Cong off!!

Over the last 6 years in the DRC, AVZ have carried out Soil Sampling, Field Mapping, Consulting, Drilling, Metallurgical Testing, Completing a FEED Study, Environmental Study and Impact Assessment Reports including Groundwater Management, a 160 page Definitive Feasibility Study, a SEZ Agreement, Tendering for Mining Infrastructure, Legally Obtaining and Paying For an Increased Share of Dathcom, Obtaining Several Offtake Agreements for both Lithium and Tin, Raising Capital, Negotiating Funding with Pan African DFI’s and a Funding and Offtake Agreement with CATH, Presenting at the Battery Minerals Conference, Legally Fulfilling all Requirements to Obtain the Mining License, Including Receiving the Ministerial Decree to Award the Mining License and producing an 85 page Sustainability Report, Spending millions of dollars and Supporting the Local Community….
Now corrupt State owned Cominiere is working with the Minister of Mines and Director General of the DRC Mining Cadastre (CAMI) to deny granting AVZ Minerals a Mining License

You cannot fight against the MOM new condition and risk loosing it all.
Except if out of left field the MOM issues a new decree issuing the ML to AVZ before negotiations commence regarding the 15% from Comminire .
As it stands Cominiere now have 25% of the project .

Arrêt also translates to stop or stoppage in English

What a rollercoaster of a week it's been. My first thoughts were to take a TO offer for the whole lot because Zijin will no doubt affect the construction timeline if they "lose" their share.
Then I was of the opinion to fuck Zijin and take this thing to ICC as long as it takes, but as everyone has suggested the MoM may be threatening lose of Dathcom ownership and Felix would have stepped in by now if he is to save the day.
It is looking more and more like there may not be around any of this without Zijin's involvement and the Dathomir claim is hanging around like a bad smell. Dathomir don't want to be involved with the project they just want money and Zijin just want to be involved no matter what so now Nigel needs to make his money.
- AVZ still have "legal title to 75%"
- Comineire sell 10% to Zijin and out of good faith they pay $100M to DRC for it. (Zijin also agree to pay 15% CAPEX).
- Comineire concede the remaining 5% to AVZ out of good faith (AVZ pay $50M)
- Zijin pay $50M to Dathomir as a condition of negotiation.
- All parties close ICC cases and sign conditions to not allow anymore ownership claims.
- AVZ only sell 9% to CATH (with a condition to still pay the $240M upfront but $150M under project payback conditions)
AVZ 71% / CATH 9% / ZIJIN 10% / DRC GOV 10%
No more ownership disputes.
No more concern about losing the northern half of 13359.
No interference from Zijin during construction as it is in their interests to succeed.

At a quick look the suggestion doesn’t look too bad providing it’s all legally waterproof as (even though we all hate) Zigin, if they could build the infrastructure quicker than anyone and if it got us to production in a year rather than two….

)Construction times are not my area of knowledgeable though, and @JAG would have to be the foreman.
Dathomir aren’t owed a single cent, if you looked into the detail you would find that out.
