MoM canceled the spilt and it now falls back under Dathcom ; if MoM felt that Cominieres beef was AVZ letting north go ; then why would she give it away to AJN?
Canceling the decree and pulling it back in line with the mining code is good and will be recorded that way I.e in line with code . Dicing it and flicking it to AJN .. well that’s just putting it back into the ‘against mining code’ heap again …. It does seem as if wires were crossed or MOM has not yet been captured by the Chinese $$.It's too politically risky for Felix to have Zijin involved in Manono right now considering the IGF report and heat from the gringos. More likely they will be given a pathway to buy into the project at a later date. Easiest way to do that is through buying out AJN to acquire the north that Dathcom waived after the DFS is complete imo

DRC can legislate that extracted resources be processed in-country. They don't have to rely on majority ownership. So best management stay in country in meetings with officials till it's sortedOne thing need to be clear, zijin did not buy the 15% illegal, cominiere/MoP sold it illegal. Zijin made a offer and they accept it. The sold of was a breach of the jv contract and avz preemptive rights. So zijin can always use the argument that they don’t know it and just made a offer which was accepted by the government.
That’s why they now playing the I‘m a angel role and just want to progress the project, but bad avz is against it and take everything hostage, so we need to go against them.
The deal between zijin and cominiere was made 18 months ago. The government did not cancel it. Everyday they have the chance to do it but they don’t. There is no way to trust the government or believe they act to help us.
Zijin don’t want to go, they will fight in the ICC as long as they can. After one year waiting for the first session this icc case can take many months maybe year/s.
But the government clearly showed now they don’t want to wait, and they don’t want to cancel the zijin deal. Instead they canceled the ML. If there is no new decree until the end of February or begin of march it seems the 30 days timeline after the favorable technical decision is not active anymore. What I believe is absolutely not a good sign.
The drc is not doing things according to their laws. Any idiot should have learned that out by now. But I have the feeling our management believe they act good or believe what ever their lawyers told them. We still waiting for 2 years for the ML and now we are more away then before. I think our management will drive the bus into the tree. With their intransigence when it’s better to give up and renegotiate. I have the bad feeling they will fight until nothing left.
