Interesting document, I am not sure why we agreed to this. Everything was ticked off for mining license, it wasn’t necessary as we could have gone to court if MoM did not approve the decree within 30 days. Why did we had to expedite the mining license?
I have a feeling our lawyers are incompetent.

I see MoM Antoinette N’Samba has been sent to Japan - Felix might’ve had enough of Xijin’s antics and may prefer Japan’s “win win” attitude for the DRC going forward.

On Wednesday December 7, 2022, a business lunch in a Japanese restaurant brought together around a table the Congolese delegation, led by the Minister of Mines, Antoinette N’SAMBA KALAMBAYI and officials from the Natural Resources Agency and Fuels as well as those of JOGMEC , structures under the supervision of the Japanese Ministry of Economy, Trade and Industry, METI in acronym.

After the welcome speech by the Director General of the Natural Resources and Fuels Agency, Mr YUKI SADAMITSU, it was time for discussion.

Mr YUKI SADAMITSU presented the list of specific minerals that Japan needs to invest in the DRC, these are lithium, manganese, nickel and cobalt.

These strategic minerals are used in the manufacture of batteries and electric vehicles.

Reputed to be a major vehicle manufacturer, Japan would like to obtain supplies directly from the DRC.

For her part, the boss of the mines presented the investment opportunities in the DRC which holds the largest world reserve of these minerals which play an essential role in the energy transition.

In a win-win spirit,

According to Antoinette N’SAMBA KALAMBAYI, the DRC not only holds these minerals, but also, it needs the expertise and technology of Japan to carry out the local processing of the said minerals in order to constitute a value chain.

To conclude, YUKI SADAMITSU reassured the Congolese Minister of Mines that Japan will also take care of the social aspect through the construction of hospitals, schools and roads in order to boost community development.


It should be noted that the Congolese delegation headed by the Minister of Mines was made up of the Principal Advisor to the Head of State, Félix-Antoine TSHISEKEDI TSHILOMBO and Coordinator of the Japan Task Force, Mrs Kelly LUNDA MAWAYA, the Secretary General of Mines, Jacques RAMAZANI and the Chargé d’Affaires of the Embassy of the DRC in Japan, Espé-Martin KAPONGO KAPONGO and the Consultant at the Embassy of the DRC in Japan, Pr LUKUMWENA NSENDA.

waiver , partial waiver , Carre., blocks etc ….Buuuuut where it stands at present ; is that this split has been cancelled and it all reverts back to one under Dathcom…so this doesn’t leave Zijin in the position they thought they were in as the north is currently not available …the 15% ROFR is still rolling around like a hot rock .

wonder if negotiations were sliding around issuing the ML or at least ML south / exploration rights North to Dathcom, whilst Zijin get to hold the 15% of the entire project I.e north and south with them paying up rightful value and providing X% project finance costs …obviously not what AVZ wants ; but it gets north and south untitled and running ; Zijin also get 15% of a potential 2 billion tonne resource .

One big question I have now is my understanding was that the expiration of our exploration licence for 13359 was null because of the application to a PE. What happens now that the PE decree was cancelled? We're back to an exploration permit for the entirety of 13359 but that had expired, or do we still have a 'pending' application for a PE which means the passed deadline still doesn't matter?

Hopefully our original four requirements to pass through the application process are still standing, because if the application process needs to be reopened or recompleted that could be another angle Zijin and the corrupt DRC mining Mafia employ to try and swoop Manono.

Has the 30 day clock restarted to receive a new Ministerial Decree I wonder? So many questions...

I remember Nigel said something like at the beginning they thought it was FT’s idea to ask them to forfeit north, but AVZ found out it wasn’t FT’s idea, so the shitshow started

Clearly he is back tracking, once we have relinquished it we might not see it again. Hence my question, who gave the legal advice to sign the renunciation application.

Application has been submitted, so once your application has been received the timing Is on CAMIs side, so that deadline your company was one up against no longer applies.

Do you know if there's been a similar situation before where the application has been approved and then withdrawn? I can't find one and suspect we may be in a new space. Because right now it's not up to CAMI right? Aren't we back now in MoM territory?

the application hasn’t been withdrawn ; it’s a partial waiver whereby yes the decrees have been scratched out ; if it was a waiver as opposed to partial waiver then we’d have a problem, as our exploration rights would be gone ; so we’re still in the game with an application whereby environmental , social impact assessment and technical approvals have all been approved which is what is required for approval and from there you wait for the decree to be issued .

Appears MoM is providing some time for Dathcom shareholders legal or not 🙄 to work things out ; so yes there may well be a timeline they wish to impose on that considering the wording ‘urgent’ and ‘paralysis of project’ , but your guess is as good as mine

Anyway it's a big fucking mess is what it is imo. Since it's all unprecedented I doubt we can expect a resolution to the Exploitation permit within 30 days. That goes out the window.
It seems to be down to negotiations, be great to know if management have even tracked down anybody to negotiate with or had a chat with the MoM or Felix.
That they've still not been able to provide shareholders an update isn't very reassuring.
