I agree they don't necessarily have to be mutually exclusive if there is evidence to support claims of money being potentially stolen but you should re-read AVZ's new lawyer's letter and AVZ's announcements on this matter imo

Seems clear that momentum are responsible for the escrow account. Thanks Carlos, where do you get these documents from.

That informal sentence seems out of place in a document replete with legalese.
Is it just a translation thing (French to English), or should we be skeptical of the document's authenticity? As we are all well aware, there are many fake documents floating around.

"The abandonment of the regime prohibiting the movement of foreigners in mining areas is not a naivety of our country
President Félix-Antoine Tshsekedi spoke on Friday, October 18, during the Council of Ministers, about the presence and movement of foreigners in mining sites.
In the minutes of this meeting, published on Sunday, October 20, the President of the Republic states that in certain mining regions, foreign operators operate completely illegally.
"Considering that the liberalization of the mining sector, under the Mining Code, has given access to this sector, throughout the Republic, to all economic operators, both national and foreign, the abandonment of the regime prohibiting the movement of foreigners in mining areas should not be seen as a naivety of our country that would give a pass to foreigners to do whatever they want," warned Félix Tshisekedi in the remarks reported in the minutes of the Council of Ministers.
This abandonment, recalls the Head of State, was rather dictated by the need to attract investors and meet the requirement of a good business climate.
In order to put an end to the abuse of the advantages resulting from this liberalization, the Deputy Prime Minister, Minister of the Interior, Security, Decentralization and Customary Affairs, the Minister of Mines and all other state services including the General Directorate of Migration have been tasked with "setting up a more elaborate and rigorous control and surveillance system to prevent access to mining sites by foreigners who do not have a regular residence permit in the Democratic Republic of Congo, or an investment in mining."
The ministers and services concerned must present their conclusions within one month.

Yes the whole point of escrow is that the lawyer holding the money becomes legally responsible. The court document detailing AVZ’s request and subsequent granting for an escrow account to be established was in the article last week from econewsdrc. The vast majority of the other documents I have were provided by either 9card or the interview given by Christian Lukusa 2 years ago.

Can you provide an example of the ‘many fake documents floating around’?
Many other allegations have been made about there being fake or possibly photoshopped documents but as yet the only document I’m aware of that has actually been proven fake and not just accused without evidence is the RCCM record that 9card provided a while back showing Zijin had been purportedly removed from Dathcom

Normally when someone asks this I check and he has been lurking in the last day or so. But he now hasn’t logged in for a month so I can’t use my SpongeBob meme this time. Possible he is still reading without logging in tho.
