The purpose of this post is to seek members' views on the apparent contradiction between the DRC Minister of Mines' recent statement about the DRC's willingness to proceed with arbitration (below), and its unwillingness to pony up its ICSID fees. As a result AVZ looks like paying the DRC's fees in order to keep arbitration alive.
"I bring to your particular attention that at the request of the company AVZ, the parties have agreed to settle the dispute amicably. The defence team has recommended the continuation of the arbitration .To date, the defence team, under the coordination of the Ministry of Justice, is working on drafting the briefs which must be filed before the Arbitral Tribunal." --DRC MoM to the DRC Prime Minister .
The apparent contradiction may be just bluff from the usual suspects who are holding only a pair of twos, but I would like to understand if there is another angle or strategy that needs consideration.
