Maybe extending the suspension is a simple, cost effective and efficient thing to do while the deal plays out?Do you think a further extension is actually required?
I presume that with these types of proceedings, there's all sorts of administrative overheads and schedules to be sorted out (i.e. it's not as though, if AVZ reinstated proceedings, on 24th June the ICSID jumps out of bed and starts the hearing).
If AVZ choose to reinitiate proceedings, I imagine a new timeline would have to be agreed, hearing dates booked and so on.
I think the inherent 'lag' created by the bureaucracy probably provides enough slack for AVZ to not do anything official until mid July if the Don hasn't whipped out his mega Sharpie by then.
(Disclaimer: I'm writing this in the hope I'll be proven wrong and there'll be an official update next week)
If proceedings recommence then I assume legal teams are activated again, additional costs may be incurred, attention needs to be paid again to the ICSID matters, focus is drawn away from the important deal negotiation, resources and energies get redirected away from the main prize of delivering a final successful buyout arrangement which right now almost feels tangible and dare I say “im…im…imminent”????
So maybe a simple little “extension please” provides inexpensive and timely “wiggle room” for just another hopefully very short period while the deal gets done?
