Just to remind everyone,
"The Company further advises that prior to the suspension, the ICSID Tribunal dismissed an application by the DRC to bifurcate the arbitration proceedings, which sought a preliminary hearing in relation to certain allegations raised by the DRC".
The bifurcation was requested by DRC on grounds of jurisdiction I.E. Management are clearly saying we are willing to negotiate but we/internationally its known we are in the right. The tribunal clearly believes the Jurisdiction challenge was not strong enough to warrant early dismissal.
@Scoota30 I think the best case would be if we could negotiate cominiere completely out of any settlement with DRC/Kobold by virtue of them already carving out the north as there 25% of the Dathcom JV (i.e no payment or settlement needed for them taking it just accept it as part of them dissolving the Dathcom JV and ceede 100% of the south to kobold in exchange for our multibillion settlement).
That would be 90% to Kobold and as per law 10% will have to go to DRC government.
Only the ICSID case against the DRC government has been postponed at this stage.
The ICC cases against Cominière and Zijin's subsidiary are still ongoing.
With an outstanding fine of 39 million Euro's with interest accumulating and 2 non compliance fines still clocking up for Cominière, on a daily basis, also still ongoing, plus a fair compensation for the northern section + the camp and, not to forget, the drilling core library, which is worth a fortune.
There is some ammo for negotiations.
AVZ - CATH/CATL negotiations are highly likely also ongoing.
Any other contenders, if there are any, will have to move pretty fast.
Never underestimate the Chinese, they will not be sitting on their hands.
CATL dearly needs a good supply of good quality lithium to replace their crappy lepodite.
BYD sources its lithium, from Brazil I believe.
